Probate is the court supervised process used to administer and manage a decedent’s estate when they die without a Trust and their assets are worth over $150k.  Unless the decedent has a Will or another document stating their wishes to the contrary, their assets will pass to their heirs by intestate succession (Probate Code § 6400-6414).  If your loved one passed away without a Trust, and has a home or other piece of real property where title is held in just their name, it is likely that their estate will need to be probated in order to sell the property or transfer it into the name of their heir(s).
